§ 2-14. DEPARTMENT OF PUBLIC WORKS.*

  • 2-14.1 Creation. The Department of Public Works is hereby created.

    2-14.2 Designation of Director of Public Works as Department Head. The Department of Public Works is under the sole direction and supervision of the Department Head who shall be designated as the Director of Public Works. In accordance with N.J.S.A. 40A:9-154.6, any person holding the position of Director of Public Works who has held that position full-time, continuously for five (5) years or more shall continue to hold that position, notwithstanding he or she is serving for a fixed term, during good behavior and efficiency and shall not be removed therefrom for political or other reasons except for good cause, upon written charges filed with the Municipal Clerk and after a public, fair and impartial hearing, except that any such person holding that position may be retired when he or she shall have attained seventy (70) years of age.

    2-14.3 Responsibilities. The Director of Public Works shall be directly responsible to the Business Administrator. The Director's responsibilities shall include, but not be limited to the following:

    a.

    The preparation, presentation, and administration of the budget of the Department of Public Works subject to statutory procedures.

    b.

    The monitoring of salary schedules and of the payment of employees of the Department of Public Works in accordance with salary guides.

    c.

    Establishment of such departmental procedures, rules and regulations as may be necessary in order to operate the Department of Public Works, subject to the approval of the Business Administrator.

    d.

    Defining and preparing job descriptions, as needed, for all management and union employees of the Department of Public Works, with annual review and updates as required.

    e.

    Establishment of personnel evaluation forms and procedures for management and union employees of the Department of Public Works.

    f.

    The supervision of and discipline of employees in the Division of Roads, the Division of Sanitation, the Division of Parks, the Division of Public Buildings and Grounds, and the Division of Vehicle and Equipment Maintenance.

    g.

    The supervision and direction of the Recycling Coordinator.

    2-14.4 Division of Roads. Within the Department of Public Works there shall be a Division of Roads. The Division of Roads shall be responsible for the maintenance of all Borough streets and roads, the maintenance of all Borough street and road traffic control signs, devices, and signals.

    2-14.5 Division of Sanitation. Within the Department of Public Works there shall be a Division of Sanitation. The Division of Sanitation shall be responsible for the collection of solid waste as may be required by law or regulation, or as may be directed by the Mayor and Council.

    2-14.6 Division of Parks. Within the Department of Public Works there shall be a Division of Parks. The Division of Parks shall be responsible for the operation, maintenance and repair of all equipment, facilities and structures located in Borough parks.

    2-14.7 Division of Public Buildings and Grounds. Within the Department of Public Works there shall be a Division of Public Buildings and Grounds. The Division of Public Buildings and Grounds shall be responsible for the operation, maintenance and repair of Borough owned buildings, structures and the Borough owned properties adjacent to the buildings and structures. The Division of Public Buildings and Grounds shall be responsible for the custodial and janitorial services of Borough owned buildings, structures and the Borough owned adjacent properties.

    2-14.8 Division of Vehicle and Equipment Maintenance. Within the Department of Public Works there shall be a Division of Vehicle and Equipment Maintenance. The Division of Vehicle and Equipment Maintenance shall be responsible for the upkeep, repair and maintenance of all Borough owned vehicles, "ride-on" equipment and all such other motorized or mechanically operated equipment, which is owned by or controlled by the Borough and which is used in behalf of the Borough for the purpose of providing municipal services to the general public.

    2-14.9 Supervisors of Public Works. There shall hereafter be established five (5) positions which shall each be known as Supervisor of Public Works. The Director of Public Works shall have direct supervision over each of the Supervisors of Public Works. The Business Administrator or the Director of Public Works may assign to any of the five (5) Supervisors of Public Works, the duty of supervising and overseeing any of the five (5) Divisions of the Department of Public Works created by this section (i.e., Division of Roads, Division of Sanitation, Division of Parks, Division of Public Buildings and Grounds, and Division of Vehicle and Equipment Maintenance).

    a.

    A Supervisor of Public Works shall be qualified by training and experience to perform the duties of the position.

    b.

    A Supervisor of Public Works shall be responsible for the direct operation, organization and planning required for the regular day-to-day disposition of duties of the Division to which such Supervisor is assigned.

    c.

    A Supervisor of Public Works shall be responsible for reporting to the Director on all services performed, all investigations performed, all complaints received by the Division being supervised, and shall be responsible for keeping and maintaining all reports, field notes, maps, surveys, plans, schematics, operating manuals, or other records of the Division being supervised.

    d.

    A Supervisor of Public Works shall be responsible for supervising the performance of all personnel in the Division to which the Supervisor has been assigned. The Supervisor shall be responsible for performing all duties assigned by the Director of Public Works and/or the Business Administrator.

    e.

    A Supervisor of Public Works may be reassigned and, if necessary, retrained so as to allow the Director of Public Works or the BusinessAdministrator to transfer any Supervisor to another division within the Department of Public Works.

    2-14.10 Designation of Principal Public Works Manager. In accordance with the "Certified Public Works Manager Law" (N.J.S.A. 40A:9-154.6a et seq.) as supplemented or amended from time to time, there is hereby established the position of Principal Public Works Manager. The Principal Public Works Manager shall be a Certified Public Works Manager as required by law. The Principal Public Works Manager shall be responsible to advise the elected officials of the Borough and the employees of the Public Works Department in the proper compliance and administration of the various laws, regulations, technical practices, operations, and management techniques with regard to public works activities conducted by the Borough. The position of Principal Public Works Manager shall be appointed by the Mayor with the advice and consent of the Council. The Mayor and Council may appoint the Director of Public Works as Principal Public Works Manager, provided that the Director is qualified pursuant to the law, or the Mayor and Council may appoint a qualified Principal Public Works Manager in any other manner as may be authorized pursuant to the law. The Principal Public Works Manager shall be directly responsible to the Business Administrator.
