§ 2-2. BOROUGH COUNCIL.

  • 2-2.1 Organization of Council. The Council shall consist of the Mayor and six (6) Councilmen elected at large in the Borough, all of whom shall be elected and take office in the manner provided by law. The term of office of the Mayor and six (6) Councilmen shall commence on January 1 next following their election.

    2-2.2 Standing Committees.

    a.

    There shall be the following standing committees of the Borough Council:

    Administration and Finance.

    Parks and Recreation.

    Planning and Zoning.

    Public Safety.

    Public Works.

    Water and Sewer.

    b.

    There shall be three (3) Councilmen appointed to each standing committee. The first Councilman appointed to the committee shall be Committee Chairman and shall call all meetings of the committee. The committee may develop, subject to Council approval, a long range plan, not to exceed five (5) years in length, for the departments within the jurisdiction of the committee, to provide for departmental goals and objectives and the improvement of departmental operations.

    c.

    The Chairman of each standing committee shall have the following powers and duties:

    1.

    He shall serve as a liaison between the Governing Body and the Borough departments covered by the subject matter of the committee.

    2.

    He shall be informed by the department heads within the jurisdiction of his committee of all major events in the department.

    3.

    He shall be consulted by the Business Administrator and the department heads within the jurisdiction of his committee of policy changes within those departments.

    4.

    He shall have access to the facilities of the department within the jurisdiction of his committee during normal operating hours.

    d.

    Under no circumstances would any Committee Chairman have the authority to act in an administrative capacity by attempting to direct department heads or Borough employees in the performance of their duties.

    e.

    Nothing in this subsection shall preclude the Mayor or any Borough Councilman from contacting the Business Administrator or any department head in an effort to resolve a citizen complaint concerning Borough services.

    2-2.3 Vacancies. Pursuant to the Borough law, a vacancy occurring in the office of Mayor, whether by resignation or otherwise, shall be filled by the Council until the next annual election and the election and qualification of a successor. At the next annual election the person elected to fill the vacancy shall be elected for the unexpired term only. All vacancies in other elective offices shall be filled by nomination by the Mayor and appointment by him, with the advice and consent of the Council expressed by a majority vote of the Council members present at the meeting, provided that at least three (3) affirmative votes shall be required for such purpose, the Mayor to have no vote thereon except in the case of a tie. All appointments to fill vacancies on the Council shall be until January 1 following the next general election. If vacancies occur at so short a period of time before the next annual election that the office cannot be filled at the election, the vacancy shall be filled in the same manner as though it had occurred immediately after the election, and the vacancy shall be filled at the next subsequent annual election for such portion of the term, if any, as may still remain unexpired. At the next annual election the person elected to fill the vacancy shall be elected for the unexpired term only.

    2-2.4 Basic Course in Local Government. The Mayor and members of the Borough Council shall, within each of their terms of office, attend one (1) or more basic training courses on their responsibilities and obligations as local government officials. Such courses should include the subjects of budgeting, policy setting, local government contracting, risk management, and the Open Public Records Act, and may be coordinated through Rutgers University, County government, the New Jersey State League of Municipalities, the New Jersey Association of Counties, the New Jersey Council of Mayors, a local Mayors Association, joint insurance fund, or other qualified instructional provider.
