§ 4-7. CHIEF OF POLICE.

    The Chief of Police shall be the municipal department head of the Police Department. In the event of a temporary absence or disability of the Chief of Police, the Chief of Police shall designate an appropriate superior officer to act as temporary department head during such absence or disability.

    b.

    The control and discipline of the Police Department and of its members shall be vested in the Chief of Police. The Chief of Police shall have the power to enforce all policies, procedures, rules, regulations, and any general or special orders or instructions which the Chief of Police may promulgate. The Chief of Police may not promulgate any rules, regulations, general or special orders or instructions which conflict with the policies, procedures, directions, orders or instructions issued by resolution or ordinance of the Mayor and Borough Council. The Chief of Police may not promulgate any rules, regulations, general or special orders or instructions which conflict with the laws or regulations of the State of New Jersey. The Chief of Police shall enforce all policies, procedures, rules, regulations, orders or instructions, whether the said policies, procedures, rules, regulations, directions, orders or instructions are promulgated by the State of New Jersey, the Mayor and Borough Council or by the Chief of Police. The Chief of Police may undertake the discipline of any violation of any of the said policies, procedures, directions, orders or instructions. Should the Chief deem the violation to be of a sufficiently flagrant nature, he shall report it to the Mayor and Council.

    c.

    The Chief of Police, with the assistance of the other members of the Police Department detailed for such purpose, shall keep complete records as prescribed in the policies, procedures, rules, regulations, orders or instructions adopted by the State of New Jersey, the Mayor and Council, and the Chief of Police. The Chief of Police shall prepare a written monthly report in writing to the Chairman of the Police Committee for presentation to the Mayor and Borough Council at their second regular meeting in each month, which report shall detail all matters of importance pertaining to the Police Department and the Chief of Police shall make recommendations which in the opinion of the Chief of Police will increase the efficiency of the Police Department.

    d.

    The Chief of Police shall recommend to the Mayor and Borough Council the purchase of new equipment or the repair or re-arrangement of such old equipment as will increase the efficiency of the Police Department. The Chief of Police shall have full charge and control of all apparatus and equipment of the Police Department and its assignment and use consistent with lawful regulations duly promulgated by the appropriate authority. The Chief of Police shall be held responsible for the care, cleanliness and safekeeping of all apparatus and equipment of the Police Department.
