§ 7-18. SCHOOL BUS ROUTES AND STOPS ("JOLENE'S LAW").

  • 7-18.1 Jolene's Law. This section shall be known and may be cited as "Jolene's Law," in memory of Jolene Devlin.

    7-18.2 Assignment of School Bus Stops. All schools, school boards and school districts (hereinafter, collectively "schools") within the jurisdiction of the Borough of Sayreville, in establishing school bus routes, if any, shall assign school bus stops, on the streets designated below, to each and every student utilizing School Bus Transportation Services, as hereinafter defined, in a manner that shall not require the student to cross such street to the opposite side of his/her residence in order to board and disembark a school bus:

    7-18.3 School Bus Transporter; School Bus Transportation Services Defined. For the purposes of this section, "School Bus Transporter" includes any corporation, partnership, sole proprietor or other entity providing School Bus Transportation Services within the Borough of Sayreville; and "School Bus Transportation Services" means the pickup, transport, and discharge, by school bus within the municipal limits of Sayreville, of any elementary or secondary school student to and from school.

    7-18.4 Contracts for School Bus Transportation Services to Require Compliance With This Section. All schools, in letting contracts to School Bus Transporters, shall contractually obligate the School Bus Transporters to follow bus routes tailored to the requirements of Section 7-18.1 hereof, and shall provide the School Bus Transporters with a listing of all assigned school bus stops, which listing shall be updated as necessary, but not less than semi-annually.

    7-18.5 School Bus Transporter Routes. All School Bus Transporters providing School Bus Transportation Services shall do so in such a manner as to schedule school bus stops along either side of the streets designated in Section 7-18.1, so that no elementary or secondary school student shall be required to cross such street to the opposite side from where his/her residence is located in order to board or disembark a school bus.

    7-18.6 The Number and Location of School Bus Stops Required Hereunder. The number and the location of school bus stops required pursuant to Section 7-18.1 hereof shall be determined by the schools which provide or contract for the provision of School Bus Transportation Services. In establishing the location and number of such school bus stops, the schools may consider reasonable recommendations made by any Parent/Teacher Associations and organizations established in such schools.

    7-18.7 Violation. Any person convicted of a violation of this section shall be subject to the General Penalty provisions of the Revised General Ordinances of the Borough of Sayreville.
