§ 8-11. MAINTENANCE AND OPERATION OF STABLES.

  • 8-11.1 License Required. Any person who keeps, operates, or maintains or proposes to establish a horse stable shall apply to the Clerk of the Borough for a license entitling him to keep or operate such establishment. A horse stable shall mean any location where one (1) or more horses are kept, harbored, or boarded. These licenses shall not be transferable to another owner or to different premises.

    8-11.2 Application Information. An application for a horse stable license shall contain the following information:

    a.

    The name and address of the applicant;

    b.

    The street address where the horse stable is located or is proposed to be located, together with a general description of premises;

    c.

    The maximum number of horses to be accommodated at any one time.

    8-11.3 Minimum Area of Location. The minimum area requirement for any one (1) location shall be as follows:

    a.

    Six thousand five hundred (6,500) square feet for one (1) horse.

    b.

    Additional two thousand five hundred (2,500) square feet for each additional horse up to ten (10) horses.

    c.

    Additional two thousand (2,000) square feet for each additional horse thereafter.

    The front yard area of the location as defined by Chapter XXVIII, Zoning, and portions of the location covered by buildings or any other structure shall not be included in computing the area of the location.

    8-11.4 Statement from Health Officer. No license shall be issued until the proposed licensee has submitted a written statement from the Health Officer and Zoning Officer that the horse stable or proposed horse stable complies with local, County and State regulations governing the location of and sanitation of such an establishment.

    8-11.5 License Term. A license issued hereunder shall expire on the last day of January of each year.

    8-11.6 License Fee. The following fees shall be established for a Stable License issued in the Borough:

    a.

    Annual license (10 horses or less)       $15.00

    b.

    Annual license (11 horses or more)       $150.00

    c.

    Annual license (after 7/1)       $25.00 surcharge

    8-11.7 Compliance with Regulations. A license issued for a horse stable shall be subject to revocation by the Council on recommendation of a State agency having jurisdiction over horse stables or the Board of Health of the Borough for failure to comply with the rules and regulations of such State agency or the Borough Board of Health, after the owner has been afforded a hearing by either the State agency or the Borough Board of Health.
