§ 8-4. SOLICITORS AND CANVASSERS.

  • 8-4.1 Permit and License Required. It shall be unlawful for any solicitor or canvasser to engage in business within the Borough without first obtaining a permit and license. The license to be issued shall contain the photograph of the individual solicitor or canvasser; said photograph being obtained from the Sayreville Police Department.

    8-4.2 Definition. As used in this section:

    Canvasser or solicitor shall mean any individual, whether or not a resident of the Borough, traveling either by foot, wagon, automobile, motor truck, or any other type of conveyance, from place to place, from house to house or from street to street, taking or attempting to take orders for sale of goods, wares and merchandise, personal property of any nature for future delivery, or for services to be furnished or performed in the future, whether such individual has, carries or exposes for sale a sample of the subject of such sale or whether he is collecting advance payments on such sales, provided that such definition shall include any person who, for himself or for another person, hires, leases, uses or occupies any building, structure, tent, railroad boxcar, boat, hotel room, lodging house, apartment, shop or any other place within the Borough for the sole purpose of exhibiting samples and taking orders for future delivery.

    8-4.3 Application. Applicants for a permit and license under this section must file with the Clerk a sworn application in writing, in duplicate, which in addition to the information required in subsection 8-1.2, shall indicate:

    a.

    The place where the goods or property to be sold are manufactured or produced, where the goods or products are located at the time the application is filed, and the proposed method of delivery.

    b.

    Whether the applicant has been convicted of a crime, misdemeanor, or violation of a municipal ordinance and, if he has, the nature of the offense and the punishment or penalty imposed.

    8-4.4 Fees. The following fee shall be established for a solicitors and canvassers license issued in the Borough:

    Annual solicitor/canvasser license       $75.00

    8-4.5 Time Restrictions. There shall be no soliciting or canvassing activities conducted between the hours of 9:00 P.M. and 9:00 A.M. for commercial and non-commercial establishments.

    8-4.6 Do Not Knock List & Unlawful to Solicit Signs Posted

    a.

    It shall be unlawful for any non-exempt person or organization to engage in any of those practices regulated by this section without having first obtained a license therefore in accordance with the applicable provisions of this section.

    b.

    The Borough Clerk shall maintain a list of names and addresses of residents who have determined that solicitors, canvassers or hawkers shall not be invited to their respective residence. Any resident shall be included on such list if they complete a form indicating their name, address, phone number and if they intend to post a sign. The form shall be made available by the Borough Clerk. The list shall be kept and maintained by the Borough Clerk and distributed to the Police Chief and all applicants seeking a license for the purpose mentioned herein. The licensee shall not solicit, canvass, or hawk upon premises listed on the DO NOT KNOCK LIST. Any solicitor, hawker or canvasser who goes upon any premises or rings a doorbell upon or near any door or creates any sound in any manner calculated to attract the attention of the occupant of such residence, when such residence is on the list provided shall be considered to be engaging in uninvited soliciting as set forth in this Section and shall be subject to the penalties set forth in Section 1.5 of the Revised General ordinances of the Borough of Sayreville.

    c.

    Those residents who have registered with the Borough Clerk pursuant to this section may post a sign in a conspicuous place on the resident's property stating:

    No

    solicitation is permitted pursuant to Section 8-4.6 of the Revised General Ordinances of the Borough of Sayreville.

    d.

    The "No Solicitation Permitted;" sign shall be no larger than six (6) inch by (9) nine inches in size and the sign shall be supplied by the homeowner/resident.

    8-4.7 Applicability. This section shall not apply to noncommercial solicitation or canvassing where the individuals involved in such activity provide the Borough Clerk with proof that such activity is noncommercial and for a nonprofit purpose.
