§ 12-5. HOUSING AUTHORITY.

  • 12-5.1 Preamble. The Borough Council of the Borough of Sayreville does hereby intend to create a housing authority for the Borough pursuant to the "Local Housing Authority Law of New Jersey", the Borough Council of the Borough of Sayreville deems it necessary to create the housing authority to provide and improve the quality of low cost housing within the Borough.

    12-5.2 Creation. A body corporate and politic to be known as the "Housing Authority of the Borough of Sayreville" is hereby created and established pursuant to the power and authority granted under the New Jersey Local Housing Authority Law (N.J.S.A. 55:14A-1 et seq.).

    12-5.3 Commissioners. Pursuant to N.J.S.A. 55:14A-4, the said Authority shall consist of seven (7) members who shall be appointed and hold office for the terms hereinafter provided.

    a.

    The Borough Council shall appoint five (5) Commissioners of the Authority, one (1) for a term of one (1) year; one (1) [or a term of two (2) years; one (1) for a term of three (3) years; one (1) for a term of four (4) years and one (1) for a term of five (5) years.

    b.

    The Mayor shall appoint one (1) Commissioner of the Authority for a term of five (5) years.

    c.

    The Director (Executive Officer of the Public Housing and Development Authority in the State Department of Conservation and Economic Development) shall, on receipt of notification of the creation of the Housing Authority, appoint one (1) member who shall hold office at his pleasure.

    After the initial appointments, Commissioners so appointed shall hold office for a term of five (5) years and until their respective successors are appointed and have qualified except that all vacancies shall be filled for the unexpired term.

    12-5.4 Powers and Duties. The Housing Authority of the Borough shall be vested with all powers granted pursuant to the appropriate enabling legislation and shall be conducted with the limitation contained therein.
