§ 12-8. REGULATIONS ON THE USE OF PORTABLE SIGNS.

  • 12-8.1 Preamble. The Mayor and Borough Council of the Borough has determined that the expanded use of portable signs is causing a visually blighting effect on the Municipality.

    12-8.2 Definitions. This section shall apply to all portable and temporary signs, billboards and freestanding advertisements including but not limited to the following:

    Portable display signs shall mean an advertising device in the shape of an "A" or some variation thereof, located on the ground, easily movable, not permanently attached thereto and which is usually two (2)-sided.

    Portable temporary attraction signs shall mean a single or double surface painted, or poster panel type sign or some variation thereof, which is temporary in nature, usually mounted on wheels, easily movable, not permanently attached thereto.

    12-8.3 Sign Permits. It shall be unlawful for any person to erect, repair, alter, relocate or keep within the Borough any sign or other advertising structure as defined in this section without first obtaining a sign permit from the Code Enforcement Officer and paying the fee required by this subsection.

    a.

    Application for Initial Sign Permit. Application for initial sign permit shall be made upon blanks provided by the Code Enforcement Officer, and shall contain or have attached thereto the following information:

    1.

    Name, address, and telephone number of applicant.

    2.

    Location of building, structure, or lot to which or upon which the sign is to be attached or erected.

    3.

    Position of the sign in relation to nearby buildings or structures.

    4.

    Name of person, firm, corporation or association erecting the structure.

    b.

    Sign Permit Fees. Every applicant, before being granted a permit hereunder, shall pay to the Code Enforcement Officer of the Borough a non-refundable permit fee of one ($1.00) dollar per square foot of sign face with a minimum fee of twenty-five ($25.00) dollars.

    c.

    Issuance of Sign Permit. It shall be the duty of the Code Enforcement Officer, upon the filing of an application for an erection permit to examine such plans and specifications and other data and the premises upon which it is proposed to erect the sign, and if it shall appear that the proposed structure is in compliance with all of the requirements of this section and all other laws and ordinances of the Borough, he shall then issue the erection permit. If the work authorized under the erection permit has not been completed within three (3) months after date of issuance, the permit shall become null and void.

    d.

    Expiration of Sign Permit. A valid sign permit issued by the Code Enforcement Officer shall expire six (6) months from the date of issue. All sign permits are renewable upon notice to the Code Enforcement Officer and payment of the required fees.

    12-8.4 Location of Portable Signs. All portable signs must be located at the site of the business being advertised or within three hundred (300′) feet of such business. No business shall be allowed more than one (1) portable sign permit at any one (1) time.

    12-8.5 Sign Maintenance. All portable signs and the premises surrounding the same shall be maintained by the owner thereof in a clean, sanitary, inoffensive condition, and free and clear of all obnoxious substances, rubbish, debris and weeds.

    12-8.6 Exemptions. Signs for the following purposes shall be exempt from the provisions of this section with the exception for the provisions of Subsection 12-8.5, Sign Maintenance:

    a.

    "For Sale" or "For Lease" signs.

    b.

    Election campaign signs.

    c.

    Public event signs.

    d.

    Window signs.

    The signs set forth in paragraphs a., b. and c. above shall be removed within seven (7) days after the event, election, sale or rental as the case may be.

    12-8.7 Penalties. For violation of any provision of this section, the maximum penalty shall not exceed one hundred ($100.00) dollars. A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.
