§ 19-5. FENCES, WALLS AND GATES.

  • (a)

    All private swimming pools or additions thereto shall be completely enclosed by a substantial, self-supporting fence or wall of brick, stone or masonry material which meets the approval of the construction official and zoning officer. The fence or wall shall be at least forty-eight (48") inches above grade and the bottom of the barrier shall be two (2") inches. The barrier shall be so constructed as not to have openings that allow passage of a four (4") inch diameter sphere. A building may be used as part of such enclosure. Barbed wire shall not be used as fencing. In no event shall the fence or wall be constructed in such a manner or way as to be in violation of any existing ordinance or regulation of the International Residential Code.

    (b)

    All gates used in conjunction with the fence or wall shall meet the same specifications as the fence and wall and shall be equipped with a self-engaging lock or latch. The gate shall be locked when the pool is not in use or properly supervised.

    (c)

    Spas or hot tubs with a safety cover which complies with ASTM F 1346 shall be exempt from these provisions.
